The Law

Massachusetts DUI law states that it is unlawful for any person to operate or be in physical control of a motor vehicle while under the influence of alcohol, drugs or an intoxicant, is he or she has a blood alcohol level of .08% or greater.

The Penalties

  • Imprisonment: Up to 30 months in jail.
  • Fines: Between $500 and $5,000, with additional fees of $250 for assessment and $50 for the Victims Trust Fund.
  • Impact on License: Suspended for 12 months.

First Offender Massachusetts Impaired Driving Program

Each individual who attends the Driver Alcohol Education (DAE) program is expected to attend 40 hours of programming, as follows:

  • One individual intake session.
  • Thirty-two (32) hours of psycho-educational group sessions (one two-hour session each week for 16 weeks).
  • Two (2) hours of victim impact awareness (MADD).
  • Four (4) hours of attendance at a community-based self-help meeting (2 Meetings).
  • One individual discharge (exit) session.
  • Upon satisfactory completion of the program, the individual will receive a certificate / letter of completion

Multiple Offender Program (MOP)

Massachusetts requires most people with a second DUI to enroll in a two week in-patient program at Tewksbury Hospital, followed by aftercare. ASAP provides an aftercare service which is usually 20 weekly sessions followed by 7 monthly sessions in the Phase III group.

Out of State DUIs

Most out-of-state courts and DMVs will accept the Massachusetts DAE course to fulfill their requirements for a drunk driving charge.

The Solution

You will be required to carry SR22 insurance for a period of 3 years. Final license reinstatement will not be granted until you properly file the SR22 form.
